Switek arrived at the supermarket where the police had sealed off the area. He walked in where he saw Crockett and Tubbs standing by the body of McGurn. He approached them.
"Well he looks very dead," said Switek. "How did it happen?" Tubbs told him the entire story. "Alright good work guys. Although it would have been better if he were alive so that we could question him. Sonny, Rico, you guys disobeyed my orders not to follow him."
"Sorry Stan," replied Crockett. "We had to get him for Castillo."
Switek understood and smiled. He figured he'd would have done it too. "Well that's ok. We'll skip the disciplinary action, this time."
"Thanks Stan," Crockett said as he smiled. "How's Zack?"
"Well he's on his way to the hospital. Hardin went with him. It looks like he'll make it. The wound wasn't that bad. Just a scratch. The good news was that he was the only one who got hit. While McGurn's men are, well, all gone."
Rico smiled. "Chalk one for the good guys."
"Well, looks like we can wrap this thing up since McGurn's gone now," Stan said.
"Wait a minute," Rico interrupted. "What about this Francis?"
"That's right," Sonny said. "He hired McGurn to do the hospital in the first place."
"Yeah but why?" asked Stan.
Sonny pulled out something from his pocket. It was a cell phone. "Maybe this might help. We found it on McGurn. Checked the call log and found only one number in the memory. I'll bet twenty to one that the number is Francis'." He handed the phone to Switek.
"Yeah you're probably right Sonny," he said as he examined the phone. "Let's take this to OCB and have the lab check it out."
"Um Stan, can we hitch a ride?" Rico asked.
"Why?"
Rico pointed to the street where a man was hooking up the now shot up Testarossa to a tow truck. A bullet hit the engine and tires had been shot to Hell.
"Awww shit!" Stan exclaimed as he ran out to the street. "You trashed the Ferrari?" He was pissed. He loved that car. After all, it was his baby. Now it was a big piece of metallic Swiss cheese.
Sonny frowned as he handed back the keys to Switek. "Sorry Stan."
After they hitched a ride from Stan back to OCB. They filled out all the paperwork on the incident while the lab traced the phone number from McGurn's cell phone. Trudy and Gina had returned from their wrap up at the St. Mary's and were starting their paperwork.
"Did we ever have this much paperwork before?" Gina asked out loud.
"Looks like we got more here than we ever did when we were still with vice," Trudy replied.
"Yeah but now we got all this stuff on the computer," said Sonny as he tried to figure out how to run the computer. The machine suddenly beeped on him and gave him an error message. "Damn! What the Hell is wrong with this damned thing?" Rico laughed as he saw his partner's frustration.
Gina came up behind Sonny and put her hand on his which was on the mouse. "Here. Double click on this and then click here and presto! All done."
Sonny turned around and smiled. "Are you flirting with me again Gina?"
Gina smiled back. "Was I flirting with you?" Rico and Trudy looked and smiled at each other as if to say uh oh, not again.
"Maybe you too need a room?" joked Trudy. Rico laughed.
Sonny smiled in embarrassment. "Awww come on man."
Switek suddenly came in the office. "Listen up guys. You aren't going to believe this. Just got word from the lab on the cell phone. Apparently, the phone number that was on the call log belongs to Daniel Bernstein."
"What?" Rico said. "You mean Senator Bernstein?"
Stan nodded. "Yup."
"That doesn't make sense," Rico thought out loud. "Why would he hire someone like McGurn?"
"Yeah," Gina said. "He's the one that's been pushing all those anti crime bills including the new assault weapons ban and the anti-terrorist bill."
"Well get this," Stan said. "His son, Francis Bernstein, was shot and killed five years ago by a gang member drive by."
Sonny thought about it for a second. Then it finally came to him. "Wait a minute. When are the most gun laws passed?"
"After a shooting massacre," Rico replied. He thought about it for a moment then it hit him. "Oh my God, Sonny. He hired McGurn to hit the children's hospital so that it would get all this publicity and he would have the public to support his gun bill."
Sonny nodded. "That's it partner. He's got a motive and that's revenge pal. Just like Stan said, his son was killed by gunfire. Why else would he do it."
Rico had to agree with that, but he still couldn't believe it. How could a politician who preaches nonviolence, resort to this?
Captain Cutter walked into the room with an excited look on his face. "Switek, I heard you got a lead on this Francis."
"Yes sir, we found out that the number belonged to Senator Bernstein."
"What? Bernstein? Are you sure?"
Switek nodded. "Yup. Sir we need to get a warrant for his arrest and we need to find him fast."
"Well the warrant should be no problem and I know where to find him too. He'll be at a fund raiser at the marina this afternoon."
"Well, what the Hell are we waiting for?" Sonny asked. "Let's go!"
Cutter held up his hands. "Now hold on Sonny. Let the rest of us handle this. We can't afford to have any loose cannons on this one. I appreciate everything you and Tubbs have done so far, really, but..."
"Bullshit Cutter," Sonny snarled. "We're gonna finish it."
"We'd like to stay on if you don't mind," Rico added. "We don't like to leave a job unfinished."
Switek stepped forward towards the Captain. "Sir, with all due respect, we need Sonny and Rico here with us. We need their experience. Plus we're short handed as it is sir."
Cutter looked at the determination of Switek and the rest of the crew. They weren't going to budge. "All right, but they come as back up got it?"
Switek nodded. "Yes sir."
"Ok, get ready to go and I'll see a judge about that warrant. Joey, Trudy, and Gina, you're with me. Stan, meet me at the marina after I get the warrant," Cutter said as he left.
Sonny slammed his fist on the desk just as Cutter left. "Son of a bitch!"
Switek tried to calm him down. "Look Sonny, relax. Maybe he's right. We can't afford to screw this up. But I do have an important job for you. Come on, let's go."
"Where are we going?" Rico asked.
Switek smiled. "I got another surprise for ya."
Senator Bernstein never liked fund raisers. To him it seemed like a polite way of asking for money but that was the nature of the beast called politics. He didn't complain about the food however. Prime rib with all the fixings and at $1000 a plate, he would get the money he needed for his campaign. At least it was something to look forward to. He sat at the edge of the table at the marina with his wife sitting next to him. He looked up at the sky and admired the view. Today's a beautiful day, he thought. Also, today was a special day where he would unveil his new crime bill. He was waiting until McGurn and his men completed the mission at St. Mary's. He looked at his watch. He would have completed the mission about an hour ago. He wondered why he hadn't called him yet.
"Honey," his wife asked as she put her hand on his. "What’s wrong?"
The Senator woke from his spell. "Oh nothing dear. I'm fine." Soon Francis, soon, he thought. Soon, McGurn's attack on St. Mary's Children's Hospital would give the wake up call that America needed. After the Columbine massacre, there was outrage over the sale of guns on the streets but nothing was really done about it. Oh sure, there was talk of closing the gun show loopholes, safety locks on all guns, and mandatory gun licenses, but that wasn't enough for the Senator. He wanted them all gone and McGurn was going to help him do it. He didn't care if he ever found out that he was being used. To Bernstein, he was just another dumb gun nut looking to kill people. The Senator would use that stupidity to his advantage.
Bernstein took another bite of his prime rib and chewed it slowly. One of his aides came up to him with a rather hurried look on his face.
"Senator," he said. "Did you guys hear about the terrorist attack this morning?"
Bernstein acted surprised. "Why no! What happened?" We're home free son.
"A bunch of terrorists attacked the St. Mary's Children's Hospital this morning." The rest of the guests, sitting at the table, gasped in horror.
"My God, how many children were killed?" the Senator asked.
"Oh nobody at the hospital were killed," the aide replied. A few of the guests sighed in relief.
"What? No one?"
"That's right. It appears that the Metro Dade Police got wind of it the night before and set up an ambush. The news reports indicate that all of the terrorists were killed while only one police officer was wounded and none were killed."
No! No! No! Bernstein thought. "Well thank God for that. Thank you for telling me." How could this have happened? How did they know? Bernstein was thinking all of the possibilities when he looked past the sea of guests at the table to see a few police cars pulling up to the marina. He looked to his left and saw two more police cars pull up. He looked back to the lead car and he saw two figures come out of it. It was Captain Cutter and Sergeant Switek. Could they have found out about me? He looked at the Captain and the Sergeant. They were looking right at him. The rest of the officers were too. He looked back at Switek. There was anger and determination in his face. He then knew that he had been found, that he was Francis. He slowly began to rise from his chair.
"Honey," his wife asked. "What's wrong?"
The Senator didn't answer. He had to get out of there. He began to retreat slowly towards the pier. Cutter and Switek picked up their pace. Bernstein, in a panic, began to run away. He found his way to the pier where a man was getting ready to set sail with his speed boat. Bernstein quickly jumped in, threw the man overboard, took the controls, and sped off.
Cutter and Switek ran towards the end of the pier as they saw Bernstein speed off in the boat. Switek pulled out his radio. "He's gotten away on boat. He's heading east, out of the pier."
Bernstein put his hand on the throttle and opened it up to full power. He began to panic. What would he do? He was made and he had nowhere to run. He began to think of the possibilities. Perhaps some of his colleagues would help him or some of his military acquaintances. All of this ran through his mind when he looked behind him off to the starboard. He saw another boat rapidly approaching him. He thought it might be joy riders until he saw the occupants. Horror ran through his body as he realized that in the boat were Crockett and Tubbs.
Thank you Stan for saving the Scarab too, Crockett thought as he and Tubbs raced across the sea to capture Bernstein. Sonny began to smile involuntarily as he powered to Scarab to full throttle. It felt good to race in his old speed boat. It was just like old times.
He and Tubbs were determined to catch Berstein. No way was he going to get away. Not this time. They would get him and Castillo's attempted killer would be put away for a long time.
Bernstein tried to get more speed out of the boat but to no avail. The other boat was just too fast. He was cornered. He couldn't go down like this. He'd rather not live than to live the rest of his life as a criminal. He looked towards the port side of the boat and saw a large oil tanker not too far from him. He realized that there was only one thing left to do as he turned the wheel to the left and headed straight towards the tanker. Soon we'll be together son.
"What the Hell is he doing?" yelled Tubbs. It took him a second to realize what Bernstein was up to. "Hey, he's gonna crash the boat into that tanker!"
"Not if I have anything to do with it partner," Sonny replied. Rico, knowing what Sonny had in mind, went to the port side of the Scarab and got ready. Sonny was able to catch up to Bernstein and he positioned the boat right next to the fleeing Senator.
Bernstein tried to ram Crockett and Tubbs with the boat was Sonny was too skilled a driver fall for that. He carefully positioned the Scarab into position. When it was just right, Rico jumped onto Bernstein's boat. Crockett then peeled off slightly to get a little more room to maneuver.
Bernstein left the controls and threw a punch at Rico. It connected on his jaw. Rico pulled away and came back with a punch of his own which found its way onto the Senator's gut. He hunched over in pain as he tried to throw another punch, but this time it was blocked. Rico then came back with an uppercut which landed on Bernstein's jaw. It wobbled the Senator's head as he went down. Just then a wave rocked the boat throwing Rico off balance. He fell on his back and struggled to get up. He looked at Bernstein who was obviously out of the fight.
Crockett looked on as the boat hurled its way towards the tanker. Damn it Rico, get out of there, he thought. By the looks of it, Rico would have very little time to either power down or turn the boat away. Come on partner, do it now!!!
Rico finally got up and grabbed the Senator. "You're under arrest you punk!" He looked up and saw that the boat was still heading right towards the oil tanker and at full speed
Get out of there now damn it! Sonny thought. It looked like Bernstein's boat was only fifty yards away from the tanker. Oh my God, Rico.
Rico couldn't reach the controls in time. There was only one thought left on his mind as the boat's bow crashed into the tanker.
"Rico no!!!!!!" yelled Sonny as he watched the boat erupt into a huge fireball. He quickly turned the boat around and towards the crash. When he got there, he powered down the Scarab. He went to the side and looked for signs of his partner. "Rico!!!!"
"Over here Sonny," Rico replied from the water behind him. Sonny looked over and was relieved to see his partner alive in the water holding Senator Bernstein by the neck. They both jumped off just in the nick of time. The Senator was flapping his arms like a bird. It was obvious he couldn't swim.
"Please," begged the Senator as he and Rico approached the boat. "Please help me. I can't swim."
Sonny wasn't in the mood for his whining. He grabbed Bernstein by the collar and hauled him onto the boat like a caught fish. Then he helped Rico get in. Sonny looked at the Senator, obviously beaten and he felt no remorse as he began to sob. To Sonny, he was scum just like McGurn. He deserved to rot in the slammer.
"We were so close Francis," sobbed Bernstein. "We were so close. I'm sorry son."
A part of Rico actually felt sorry for him. He understood why he did it but it was just plain out wrong. He looked at the Senator, who he saw once as a strong willed man, be reduced to nothing and for one brief moment, he pitied. That moment was washed away when he thought of Castillo, lying in the hospital bed. Sonny, who was getting tired of his whining, pulled out his cuffs, put them on Bernstein, and read him his rights.
